In a significant regulatory shift, the Environmental Protection Agency (EPA) has formally revoked a long-standing scientific determination that greenhouse gases endanger public health and welfare. This foundational "endangerment finding," originally established in 2009, served as the legal cornerstone for a wide range of federal climate policies, including vehicle fuel economy standards and regulations on power plant emissions.
The agency's new rule asserts that the original finding was based on what it calls "flawed" legal reasoning and is no longer considered appropriate. Officials stated the move provides regulatory certainty by eliminating what they view as an improper basis for future rules. This action finalizes a proposal that has been anticipated since last year.
Environmental groups and many scientists have condemned the decision, warning it severely undermines the nation's framework for addressing climate change. They argue the scientific evidence linking greenhouse gas emissions from burning fossil fuels to global warming and its harmful effects—including more intense heatwaves, storms, and rising sea levels—is stronger now than ever.
Legal challenges are expected immediately. Opponents will likely argue the EPA is disregarding its core mandate under the Clean Air Act to address pollutants that pose a threat to human health. The reversal marks a major departure from previous administrations and is set to define a central environmental policy battle.
